Terms of service

Overview

This website is operated by QUINE SOLUTIONS LTD, a private limited company registered in England and Wales under company number 15199379, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. We trade under the name Anya.

Throughout this site, the terms "we", "us" and "our" refer to QUINE SOLUTIONS LTD. We offer this website, including all information, tools and services available from it, to you, the user, subject to your acceptance of these Terms of Service together with our Privacy Policy, Shipping Policy and Refund Policy, each of which forms part of these Terms.

By visiting our site or purchasing from us, you engage in our services and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

You can contact us at any time at hello.anya@getanya.co. We respond to all enquiries within 1 business day.

1. Online store terms

By using this site, you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian to use this site.

You must not use our products or website for any unlawful or unauthorised purpose, or in a way that breaches any applicable UK or international law.

Any breach of these Terms may result in suspension or termination of your access to our services.

2. General conditions

We reserve the right to refuse service to anyone where we have a legitimate reason to do so, such as suspected fraud, abuse, or breach of these Terms.

Our site uses SSL encryption. Payment details are encrypted during transmission and are processed by our payment providers; we do not store your full card details. Other content you submit may be transferred unencrypted over various networks.

You must not reproduce, copy, sell or exploit any part of the website or our services without our prior written permission.

3. Products, descriptions and availability

We make every effort to ensure that product descriptions, images, dimensions and prices are accurate. Colours may vary depending on your screen, and because many of our pieces are made by hand, small variations between individual items are normal and are part of their character.

All products are subject to availability and may be withdrawn at any time.

Nothing in this section limits your legal right to receive goods that are of satisfactory quality, fit for purpose and as described.

4. Prices and currency

All prices on this website are set in pounds sterling (GBP). If your local currency is displayed, this is a conversion for reference and the final charge is subject to the exchange rate applied by your bank or card provider, which may also apply its own conversion fee.

The price of an item is the price shown at the time you place your order. We may change prices at any time, but changes will not affect orders that have already been confirmed.

The price shown at checkout does not include any customs duties, import taxes or handling fees that may be charged by your country's authorities. These are your responsibility. See our Shipping Policy for details.

Delivery costs are calculated and shown at checkout before you enter payment details and before you confirm your order.

5. Orders, contract formation and payment

When you place an order, you are making an offer to buy. Your order is accepted, and a contract is formed between us, when we send you a dispatch confirmation email. An order confirmation email acknowledging receipt of your order does not by itself form a contract.

You agree to provide current, complete and accurate information for all purchases and to keep your details up to date.

We may refuse or cancel an order where the item is unavailable, where there has been a pricing or description error, or where we reasonably suspect fraud or unauthorised activity. If we cancel an order after payment has been taken, we will refund you in full.

If we cancel or amend an order, we will contact you using the details you provided at checkout.

6. Delivery

Delivery destinations, dispatch times, estimated delivery windows, delivery costs and customs charges are set out in our Shipping Policy, which forms part of these Terms.

Unless otherwise agreed, we will deliver your order without undue delay and in any event within 30 days of the day the contract is formed. Risk in the goods passes to you when the goods are delivered to you or to a person you have nominated.

7. Cancellation, returns and refunds

If you are a consumer in the United Kingdom or the European Union, you have a statutory right to cancel your order within 14 days of receiving it, without giving a reason. In addition, we offer all customers a voluntary 30-day return window.

Full details of both, including how to cancel, who pays return postage, refund timeframes and the model cancellation form, are set out in our Refund Policy, which forms part of these Terms.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or equivalent consumer protection law in your country of residence.

8. Optional tools and third-party services

We may provide access to third-party tools or services which we do not control. These are provided "as is" and we make no warranties in respect of them.

Use of third-party services is at your own risk and subject to that third party's own terms.

9. Third-party links

Our website may include links to third-party websites. We are not responsible for the content, accuracy or practices of those websites, and inclusion of a link does not imply endorsement.

10. User content

If you submit comments, reviews, feedback or other content to us, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish that content in connection with our business.

You must not submit content that is unlawful, offensive, defamatory, or that infringes the rights of others. We may remove any such content.

11. Personal information

Your submission of personal information is governed by our Privacy Policy.

12. Errors and inaccuracies

We reserve the right to correct any errors, inaccuracies or omissions on the website, including in pricing and product information, and to cancel affected orders where the error is obvious and could reasonably have been recognised as an error. Where we cancel an order for this reason, we will refund you in full.

13. Prohibited uses

You must not misuse the website, including by introducing viruses or malicious code, attempting unauthorised access, collecting data about other users, scraping the site, or engaging in unlawful, harmful or abusive behaviour.

14. Liability

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any breach of your statutory rights in relation to the goods.

Subject to the above, we are not liable for any loss that was not foreseeable at the time the contract was formed. Loss is foreseeable if it was obvious that it would happen, or if both parties knew it might happen when the contract was formed.

If you are buying as a business rather than as a consumer, we are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.

15. Indemnity (business customers only)

If you use this website in the course of a business, you agree to indemnify us against any losses, claims or reasonable expenses arising from your breach of these Terms or misuse of the website. This clause does not apply to consumers.

16. Termination

We may suspend or terminate your access to the website if you materially breach these Terms. Any obligations incurred before termination will continue to apply.

17. Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be severed and the remaining provisions will continue in full force.

18. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, constitute the entire agreement between you and us regarding your use of this website and any purchase from us.

19. Complaints

If you are unhappy with anything about your order or our service, please contact us first at hello.anya@getanya.co. We aim to acknowledge every complaint within 1 business day and to resolve it within 14 days.

20. Governing law and jurisdiction

These Terms of Service are governed by the law of England and Wales.

If you are a consumer, you benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on those mandatory provisions, or your right to bring proceedings in the courts of your country of residence.

21. Changes to these terms

We may update these Terms from time to time. The current version will always be available on this page, and the date at the top will be updated. Changes will not apply retrospectively to orders already placed.
